Who we are
These terms govern your use of assetixfoundry.com and any purchase made through it, whether a shop product or a commission package. The site is operated by Assetix Foundry, R. Srg. José Paulo dos Santos 75, 1800-310 Lisboa, Portugal ("we," "us," "the studio"). By placing an order, you agree to these terms.
What you can buy
Two kinds of item, both shown with a real price:
Shop products — instant-download digital assets (UI kits, site templates, brand-asset packs and bundles), each sold under a Personal, Team or Extended licence (see "Digital product licences" below).
Commission packages — fixed-scope design engagements. Most packages carry a published price and can be added to cart directly; a small number of open-scope tiers are marked "price on request" and require you to discuss scope with us first.
Prices and VAT
All prices on the site are shown in EUR, excluding VAT, with VAT calculated at checkout based on your billing country. When live payment processing is enabled, our checkout provider acts as merchant of record for EU sales: it determines the correct VAT treatment, adds it to your total, and remits it — you don’t need to handle EU VAT/OSS registration yourself as a buyer. Prices may change at any time; the price shown to you at checkout is the price you pay.
How a contract is formed
Adding an item to your cart is not an order. A contract is formed, and we’re bound to deliver, once your payment is successfully processed and you receive an order confirmation with a reference number. For commission packages, that confirmation also starts the kick-off window described in "Commission engagements" below.
Digital product licences
Every shop product is sold under one of three licence tiers, always the same three, never renamed per product:
Personal — one seat. Use in unlimited personal projects, or in work delivered for a single client project.
Team — up to 10 seats within one organisation. Use across any number of internal or client projects.
Extended — unlimited seats. Everything in Team, plus the right to incorporate the asset into a derivative product that you sell on (for example, a site built from a template, or a component set built using the files as part of a larger paid product).
At every tier, you may not: redistribute or resell the source files themselves, claim authorship of the original design, or use the assets to build a directly competing UI kit, template or icon product for resale. Full plain-language permissions are shown on every product page before you buy. A licence is a one-time purchase and does not expire; it includes updates for as long as we ship the major version you purchased (see the Refund & Cancellation Policy and each product page for version details).
Commission engagements
Each commission package publishes its own turnaround and inclusion list on its service page — that list is the scope of the engagement. Once your order is confirmed, kick-off is scheduled within 5 business days; we confirm the plan and any information we need from you by email before work begins. Deliverables and ownership of the work transfer to you on full payment, as stated in the package’s handover list. Work outside a package’s published inclusion list is scoped and agreed separately before it begins — we don’t expand scope without your agreement on price.
Delivery
Shop products deliver instantly: download links and your licence key are sent to the email address used at checkout, immediately after payment. In live payment mode, this is handled by our checkout provider as merchant of record.
Commissions don’t ship a "file" at the point of purchase — delivery is the completed engagement, handed over per the package’s stated deliverables once the work is done.
Your right of withdrawal
As an EU consumer, you generally have a 14-day right to withdraw from an online purchase without giving a reason. For digital content delivered immediately as a download, that right is waived once you download the file and expressly acknowledge the waiver at checkout, in line with Article 16(m) of the EU Consumer Rights Directive (2011/83/EU), transposed in Portugal by Decreto-Lei n.º 24/2014. Intellectual property
Until full payment and handover under "Commission engagements" above, all design work, files and drafts remain the intellectual property of Assetix Foundry. The site itself — its design, copy, code and the "Assetix Foundry" mark — is also our property or used under licence; nothing in these terms grants you rights to it beyond the specific product or commission you purchase.
Acceptable use
You agree not to use the site to attempt to disrupt its operation, to circumvent licence terms, or to misrepresent your identity when placing an order.
Liability
Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud or for death or personal injury caused by negligence. Beyond that, our liability for any claim relating to a purchase is limited to the amount you paid for the item giving rise to the claim.
Governing law and disputes
These terms are governed by the laws of Portugal. Any dispute that can’t be resolved directly with us will be submitted to the competent courts of Portugal, without prejudice to any mandatory consumer-protection rights available to you in your own country of residence as an EU consumer. As an EU consumer, you can also raise a complaint through the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
Changes to these terms
We may update these terms as the site, our catalogue or our processes change. The version in force at the time you place an order is the one that applies to it.
